CHAPTER 130: OFFENSES AGAINST CITY REGULATIONS

§ 130.01 CURFEW FOR MINORS.
(A) It is a curfew violation for a child 15, 16, or 17 years of
age to be in any public place, including streets, alleys or
sidewalks within the corporate limits of the city during the
following times:
(1) Between 12:00 a.m. and 5:00 a.m. on Saturday or Sunday;
(2) After 10:00 p.m. on Sunday, Monday, Tuesday, Wednesday, or
Thursday; or
(3) Before 5:00 a.m. on Monday, Tuesday, Wednesday, Thursday, or
Friday.
(B) It is a curfew violation for a child under 15 years of age
to be in a public place after 10:00 p.m. or before 5:00 a.m. on
any day.
(C) This section does not apply to a child who is:
(1) Accompanied by the child's parent, guardian, or custodian;
(2) Accompanied by an adult specified by the child's parent,
guardian or custodian; or
(3) Participating in, going to, or returning from lawful
employment, a school sanctioned activity, or a religious event.
(D) Each member of the police, while on duty, is hereby directed
to take into custody any minor violating divisions (A)(1)
through (3) and (B) of this section, and to take the minor while
in custody to the police department and there determine the name
of the parent, guardian, or other person having custody of the
minor. It shall be the duty of the police officer thereafter to
issue a warrant for the arrest of the parent, guardian, or other
person having custody and/or legal care of the minor.

4 Mitchell - General Offenses
§ 130.02 DISCHARGE OF FIREARMS PROHIBITED IN CITY LIMITS.
(A) It is unlawful for any person to do any of the following
within the city limits:
(1) To shoot or discharge a pellet or B B gun;
(2) To shoot or discharge a firearm ;
(a) Firearm includes, but is not limited to, a revolver of any
type, pistol of any type, rifle of any type, shot gun of any
type, and includes those firing projectiles by means of
smokeless gunpowder as well as black powder.

§ 130.03 USE OF ROLLER BLADES AND ROLLER SKATES PROHIBITED IN
CITY LIMITS.
(A) No person shall use or ride roller blades upon the streets,
alleys, public parking lots, or sidewalks of the city.
(B) No person shall use or ride roller skates upon the streets,
alleys, public parking lots, or sidewalks in the city.

§ 130.99 PENALTY.
(A) Any parent, guardian, or other person having custody and/or
legal care of the minor failing in the provisions of § 130.01 of
this chapter shall, upon conviction, be fined in the appropriate
county court having jurisdiction over this matter, which court
shall determine the amount of the fine of $250 per violation,
plus the costs and disposition for each such offense.

(B) Any person adjudged to have violated § 130.02 shall be fined
$100 for the first offense, and $200 for the second and
subsequent offenses, to which shall be added the costs of this
action.

(C) Every person convicted of a violation of any provision of §
130.03 shall be punished by a fine of not more than $10 for the
first violation, $25 for the second violation, and $50 for the
third and each subsequent violation.
